1. Supply
The JCAD Software (hereinafter "the Software") is supplied to the customer with a user licence as set out in the
JCAD SOFTWARE LICENCE AGREEMENT and under the other terms set out in the Licence Agreement for use by the customer. The customer declares and warrants that he/she has read the JCAD SOFTWARE LICENCE AGREEMENT carefully prior to purchasing a Software user licence and accepts the Licence Agreement "as is". The user licence shall be supplied via Jidea's website, so the customer downloads it to his/her workstation him-/herself.
2. Payment terms
The customer shall pay the fee for a restricted user licence prior to downloading the Software from Jidea's website, using a payment method offered and available on Jidea's website..
3. Cancellation and returns
Orders or purchases of the Software cannot be cancelled once made. Purchases of the Software are always final and Jidea will not refund payments made for Software user licences.
4. Force Majeure
Jidea shall not be liable for delays in delivery, non-delivery, damage or other similar disruptions caused by factors outside its control or unforeseen factors.
5. Entire Agreement and order of precedence
In addition to these Terms of Delivery, a JCAD SOFTWARE LICENCE AGREEMENT has been agreed between the customer and Jidea. In the event of a discrepancy between these Terms of Delivery and the JCAD SOFTWARE LICENCE AGREEMENT, the JCAD SOFTWARE LICENCE AGREEMENT shall be applied first, followed by these Terms of Delivery.
